CAMPBELL NEWMAN BROKE HIS PRE- 2012 ELECTION PROMISES TO RESTORE RIGHTS AND NOT GIVE SIBELCO ANYTHING MORE
Prior to the 2012 State election, Campbell Newman announced the LNP’s policy on Steve Austin’s popular ABC Radio program. As the transcript shows, Campbell Newman said he would restore rights on Stradbroke and not give Sibelco anything more. Campbell Newman did not resile (publicly) from these key promises before he was elected. Had he kept his promise and restored rights, Sibelco would have had a right to have its applications to extend mining to 2027 considered by the government. But, importantly, despite false claims by Sibelco, it had no automatic right to extension of expired mining leases under existing mining laws.
Under existing legislation, opponents also had rights to object and challenge any extension decision in the Supreme Court. They had legal advice that in the special circumstances applying on Straddie, they had a good case to overturn any extension and end sand mining at the main mine (see legal opinions below).
